An issue – a material proposition of fact or law which is affirmed by one party and denied by the other – can be framed at any stage and the Court’s failure to do so can be remedied by the parties.
The suit is based on the Direct Selling Guidelines 2016. Hence, an additional issue of maintainability of the suit can be framed, as the Guidelines were subsequently withdrawn.
